1. Intellectual property rights

The HeadSmart Project has been endorsed by the Royal College of Paediatrics and Child Health (RCPCH), and the Project is run in conjunction with The Brain Tumour Charity and the Children's Brain Tumour Research Centre (CBTRC) at Nottingham. It is funded by the Health Foundation and The Brain Tumour Charity.

The content, layout, design, data, and graphics on our websites are protected by UK and other international copyright laws. You agree not to adapt, alter or create any derivative work from any of the material contained in the websites or to use the material for any purpose other than your personal, non-commercial use. None of the content of the websites may be copied or otherwise incorporated into or saved in any other website, electronic retrieval system, publication, or any other work in any form (whether hard copy, electronic, or other). For the avoidance of doubt, framing of this site or any part of it is not permitted without our express written permission.

2. Permission for use of our intellectual property

Any requests for permission to use our images or other use of our intellectual property not authorised by these terms and conditions should be made to info@headsmart.org.uk

3. Use of the HeadSmart brand and partner logos

The unauthorised copying and use of the HeadSmart brand (including name, logo, creative design and materials), or any third party logos accessed via this website, is not permitted. You do not have an automatic right to use HeadSmart brand. HeadSmart materials and resources may only be produced by the project team, which are then approved by the project board.

However, you may refer to, and publicise, the HeadSmart campaign if you agree to the following:

  • To use the names and logos of the four main partners and acknowledge the four partners in any reference to or use of the HeadSmart literature, information or brand.
  • At no time must the use and/or context of the HeadSmart brand bring HeadSmart or any of the partners into disrepute. Any HeadSmart partner organisation will be entitled to instruct any individual or organisation to remove the logo/links/information if, at its absolute discretion, it considers that continued use is the good name and reputation of HeadSmart or any of the partner organisations.
  • HeadSmart and the partner organisations are not liable for any costs that may arise from the requirement for an individual or organisation to cease using the HeadSmart brand.
  • The HeadSmart partners each reserve the right to seek all remedies available by law for any violation of these terms of use, including any violation of their rights in the HeadSmart name and brand especially as used in conjunction with those of the partner organisations and their rights in connection with the information, artwork, text, video, audio, or pictures (together, the "Content") of the HeadSmart website and printed materials.

These guidelines must be followed. They are simply intended to maintain a consistent look for the HeadSmart brand and to prevent its misuse.

You can download materials and resources from the website or request printed copies.

You may also, subject to availability, request materials and resources from the website either free or at a small cost.

4. Personal data and privacy

Use of the data you provide to us or which is collected by use of our websites, is governed by our Privacy Policy.

5. Links

Our websites contains links including hyperlinks which may take you outside of the resource you are currently viewing. Links are provided for your convenience, and inclusion of any link does not imply endorsement or approval by us of the linked website its operator or its contents, and we are not responsible for the content of any website outside of the HeadSmart website.

6. Donations

The Website uses the 'Just Giving' donation option, which is an external website and has its own terms and conditions that users should review if choosing to make a donation.

7. Events beyond our reasonable control

To the fullest extent permitted by law we will not be held responsible for any delay or failure to comply with our obligations under these conditions if such delay or failure arises from any causes which is beyond our reasonable control including reasons of Force Majeure which shall include any default due to an act of God, war, threatened war, act of terrorism or threatened terrorism, lock out, individual action, fire, flood, drought, tempest or other event beyond our reasonable control. This provision does not affect your statutory rights.

8. Alternation of service or amendments to conditions

We reserve the right to make changes to our website, policies and terms and conditions at any time. You shall be subject to the policy's terms and conditions in force at the time that you use the website. If any of these conditions are deemed invalid, void or unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any other condition.

9. Disclaimer

All readers should be aware that professionals in the field may have different opinions. Because of this fact and also because of regular advances in medical research, we strongly recommend that readers independently verify facts.

Orders for HeadSmart materials are subject to availability and the HeadSmart partners reserve the right to refuse to accept any request for materials and to refuse to supply any materials to any individual.

10. Waiver

If you breach these conditions and we take no action, we are still entitled to use our rights and remedies in the future and where you continue to breach these conditions.

12. Viruses

Whilst the HeadSmart project makes all reasonable attempts to exclude viruses from the website it cannot ensure such exclusion and no liability is accepted for damage caused through the downloading of viruses. Therefore, you are recommended to take all appropriate safeguards before downloading information from the Website.

13. Governing law and jurisdiction

To the fullest extent permitted by law, these conditions shall be governed by and construed in accordance with the laws of England and Wales. You agree, as do we do, to submit to the exclusive jurisdiction of the English Courts, save where it is necessary for enforcement proceedings to bring proceedings against you outside of England.
